Pursuant to the powers of the town under I.C. 36-9-36-17, the purpose of this act is to establish a general obligation of the owners of property to repair, restore or maintain public sidewalks and curbs abutting their property when such action is determined to be appropriate and is so ordered by the Town Council. The procedures prescribed herein are intended to be permissive and discretionary in respect to the Town Council, and do not preclude the Council’s utilizing and implementing any other lawful method and procedure to provide for the repair and maintenance of public sidewalks and curbs in circumstances where it deems such alternate method and procedure to be more equitable or appropriate.
