(A) RESPONSIBLE BIDDER, for construction contracts, means a bidder as defined in 55 ILCS 5/5-1022(b). The county will also consider:
(1) All applicable laws prerequisite to doing business in the state;
(2) Evidence of compliance with:
(a) Federal Employer Tax Identification Number or Social Security number (for individuals); and
(b) Provisions of 42 U.S.C. § 2000(e) and Federal Executive Order No. 11246 as amended by Executive Order No. 11375 (known as the Equal Opportunity Employer provisions).
(3) Certificates of insurance indicating the following coverages: general liability, worker’s compensation, completed operations, automobile, hazardous occupation, product liability, and professional liability;
(4) Compliance with all provisions of the State Prevailing Wage Act, including wages, medical and hospitalization insurance, and retirement for those trades as covered in the Act; and
(5) Active participation in apprenticeship and training with craft specific programs approved and registered with the United States Department of Labor’s Bureau of Apprenticeship and Training.
(B) Highway Department projects shall be exempt from provisions in this section that are not in concurrence with the State Department of Transportation rules.
(C) The provisions of this section shall not apply to federally funded construction projects if such application would jeopardize the receipt or use of federal funds in support of such a project.
(D) All contractors and sub-contractors are required to turn in certified payroll on a weekly basis.
(E) All bidding contractors or sub-contractors performing work on public works projects in the county shall provide proof that they have a program or policy in place for the prevention of drug abuse.
(F) Certification from the bidder that all employees expected to perform work on the project have completed a ten-hour or greater OSHA safety program in the last five years. Only workers who have satisfactorily completed a ten-hour or greater OSHA safety program will be allowed to participate in the project. The bidder must have copies of employee is OSHA cards on file and the county may request that the bidder provide copies of employee OSHA cards. Failure to produce an employee’s OSHA card may result in determination that a bidder is not a responsible bidder.
