(A) The county will maintain those drainage facilities that are on public land and have been dedicated and accepted for maintenance or stipulated by agreement for maintenance by the county. All other drainage facilities shall be the responsibility of the owner of the property on which they exist or the owner of the drainage facility, regardless of whether or not dedicated easements or rights-of-way exist over said facilities.
(B) (1) The responsible party shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed to achieve compliance with conditions of this permit. Proper operation and maintenance includes effective performance, adequate funding, adequate operator staffing and training, and appropriate quality assurance procedures.
(2) Abandonment and alteration, either structural or operational, of all facilities and systems shall occur only following application and issuance of a permit.
