§ 95.188 EXISTING NONCONFORMING ACCESS.
   To the extent that there exists any driveway which provides access to any village street or roadway which was lawful prior to the date on which this subchapter became effective, but which would not comply with the minimum standards specified in § 95.187 above, such nonconforming driveway may continue to provide access, so long as it otherwise remains lawful, subject to the following provisions:
   (A)   No such nonconforming driveway shall be enlarged, increased, altered or extended unless it is to make such nonconforming driveway comply with the minimum standards specified in § 95.187;
   (B)   Should such nonconforming driveway is destroyed by any means to an extent of more than 50% of its replacement cost at the time of destruction, it shall not be reconstructed except in conformity with the minimum standards specified in this section; and
   (C)   When the use of such nonconforming driveway is discontinued or abandoned for six months or for 18 months during any three-year period, the subject driveway shall not thereafter be used except in compliance with the minimum standards specified in this section.
