Applications for such permits shall be made to the Clerk and shall describe the location of the intended excavation or tunnel, the size thereof, the purpose therefor, and the person, firm or corporation doing the actual excavating work; and the name of the person, firm or corporation for whom or for which the work is being done, and it shall also contain an agreement that the applicant will comply with all ordinances and laws relating to the work to be done.
(A) All applicants, who plan to excavate pursuant to this subchapter on public or private property, shall contact Julie 811 or www.call811.com for location of all utility lines at least two days prior to the excavation.
(B) Anyone who fails to contact Julie prior to excavating, shall receive a written warning for the first offense.
(C) Anyone who fails to notify the aforementioned authorities a second time, shall, upon conviction, be fined in accordance with the provisions of § 10.99 of this code of ordinances.
(D) Anyone who damages any of the municipal utility systems and/or appurtenances during an authorized or unauthorized excavation, shall be assessed a charge or fee that reflects all material, labor and gas or water losses resulting from the said damage. The Superintendent shall prepare an itemized list of charges.
