§ 95.065 PERMIT REQUIRED.
   For a permit to cut, dig, excavate or tunnel in, through, or under any street, avenue, alley, roadway or other public place, the applicant shall deposit with the Village Clerk an amount equal to the sum, as estimated by the Village Engineer so that such street, avenue, alley, roadway or other public place will be restored to its original condition upon completion of work covered by the application and permit. The payment of said deposit does not constitute a fee intended to relieve the applicant of responsibility from restoring the street, avenue, alley, roadway or other public place to its original condition upon completion of its work but as a security deposit to be refunded to the applicant when the Superintendent is satisfied that the repair and restoration work has been properly completed by the applicant or retained by the village and applied toward the cost of such repair and restoration if the applicant does not properly complete the restoration and repair in a timely manner.
