§ 92.55 CERTAIN TREES DECLARED A NUISANCE.
   (A)   Nuisance declared. Any tree, or portion thereof, determined by the Superintendent to have contracted a lethal, communicable disease or insect; to be dead or dying; to obstruct the view of traffic signs or the free passage of pedestrians or vehicles; or that threatens public health, safety, and welfare of the village and its residents, is declared a nuisance; the village may order its treatment or removal in a manner that complies with § 95.050.
   (B)   Duty of owners of private property. Private property owners have the duty, at their own expense, to remove or treat trees on their property that are declared to be a nuisance. The village is empowered to remove such nuisances at the owner's expense if the owner does not comply with treatment and/or removal as specified by the Superintendent within the written notification period.
