§ 155.032 REVIEW OF ADVERSE PLANNING COMMISSION’S DECISIONS.
   (A)   If the Planning and Zoning Commission recommends disapproval of a preliminary plat or final plat, or a preapplication map of a minor subdivision, the subdivider may file with the Village Clerk a petition to the Village Board for review of such decision of the Planning and Zoning Commission, pointing out those parts of the decision to which the subdivider objects. In such event, a hearing on the sufficiency or propriety of said preliminary plat or final plat shall be conducted by the Village Board after notice thereof has been mailed by the Village Clerk at least one week before the hearing to the person or persons who requested the review and to the Planning and Zoning Commission Chairperson; provided, however, that any matter which was the subject of a previous hearing before the Village Board in connection with the same proposed subdivision shall not be the subject of a second hearing.
   (B)   After the conclusion of any such hearing, the Village Board may by majority vote of the total Board, affirm the recommendations of the Commission, or by two-thirds majority vote of the total Board modify the recommendation of the Commission to approve the preliminary plat or final plat. If a preliminary plat or a minor subdivision preapplication map is so approved by the Village Board, the subdivider shall proceed before the Planning and Zoning Commission with subsequent review steps provided by this chapter.
