For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ANIMAL. Any living creature domestic or wild, except human beings.
ANIMAL CONTROL OFFICER. Any person or persons designated by the Fulton County Commissioners or law enforcement officer who is qualified to perform such duties under the authority of this chapter and the state.
ANIMAL SHELTER. A facility for the purpose of impounding and/or caring for animals held under the authority of this chapter or state law.
KENNEL. A place primarily for keeping four or more adult dogs or other small animals that are ordinarily bred for sale as pets. Also could include temporary care facility for compensation. Includes any premises where in any person engages in the business of boarding, breeding, buying, letting for hire, training for a fee, or selling dogs and cats.
OWNER. Any person, partnership or corporation owning, keeping or harboring one or more animals. An animal shall be deemed to be owned if kept or harbored, fed or sheltered for three consecutive days or more.
PERSON. Any individual, partnership, company or corporation.
PET. Any animal kept for pleasure rather than utility.
PUBLIC NUISANCE. Any animal or animals which:
(1) Molests passersby or passing vehicles;
(2) Attacks other animals;
(3) Trespasses on school grounds;
(4) Is repeatedly at large or unrestrained;
(5) Damages private or public property;
(6) Barks, whines or howls in an excessive, continuous or untimely fashion.
RESTRAINT. Any animal secured by a leash or lead, or under the control of a responsible person and obedient to that person's commands, or within the real property limits of its owner.
