(A) The Countywide Department of Community Development (hereinafter referred to as “Department”) is hereby authorized and directed to administer and enforce all of the provisions of this subchapter and the Building Commissioner, (as Building Commissioner, Electrical Inspector and Plumbing Inspector) shall act on behalf of the Department for these purposes on a non-exclusive basis.
(B) The Building Commissioner, after having been designated as the officer of the Department to administer and enforce building regulations by mutual agreement by and between the town and the county, shall be authorized to issue building permits, collect permit fees, perform inspections, order connection of violations and authorize occupancy of buildings and structures situated within the corporate limits of the town.
(C) The Building Commissioner shall not engage in, or have a pecuniary interest in, any business of building construction, either directly or indirectly, which operates in the jurisdiction of the Building Commissioner.
(D) The Building Commissioner is hereby authorized and directed to administer and enforce the following:
(1) All of the provisions of this subchapter;
(2) Variances granted in accordance with I.C. 22-13-2-11; and
(3) Orders issued under I.C. 22-12-7.
