§ 93.04 OWNER RESPONSIBILITY; MAINTENANCE.
   (A)   Sidewalks within the town shall be the responsibility of each property/land/lot owner to maintain and be financially responsible for.
   (B)   The owner is required on the land/lot/ owner’s property along the streets, when one or more of the following circumstances arise, all in accordance with the requirements of applicable law, to maintain or repair the sidewalk:
      (1)   When the area is primarily comprised of three or more lots per gross acre;
      (2)   When the area is close to pedestrian generators, for example schools, parks or retail areas;
      (3)   To continue a sidewalk on an existing street;
      (4)   To link together areas of development;
      (5)   To provide pedestrian access to future development; and/or
      (6)   When the Town Council determines to do a street upgrade and has the majority in number of affected tracts and assessed valuation of the affected record property owners’ express written approval.
