§ 53.38 QUALITY AND CAPACITY SURCHARGE.
   In addition to otherwise applicable rates and charges for the availability and service of the system as hereinbefore established, and so that the utility’s rates and charges are more equitable and just, the town does hereby establish quality and capacity surcharges as follows:
   (A)   Limitations on the composition of discharges into the system require, and there is hereby established, a quality surcharge equal to an additional 100% of the then applicable per gallon treatment charge of discharge into the system will be assessed by the town, and paid by the responsible customer to the town, on the volume of material that is not qualifying waste as defined above in this chapter; and
   (B)   Limitations on volume of flow, so that the material in the system can be properly processed require, and there is hereby established, a capacity surcharge equal to an established percent of the then applicable per gallon treatment charge of discharge into the system that would have applied to the excess had it been within the volume limitations, times the number of gallons by which the metered flow exceeded the maximums, all as determined by the town, shall be assessed by and paid to the town by the responsible customer as shall be established.
