11-4-5: STORM DRAINAGE:
The subdivider shall provide the subdivision with an adequate storm water drainage system to properly drain the subdivision and all areas upstream that are tributary to the subdivision in accordance with the following specifications:
   (A)   The storm water runoff rate from the subdivision shall not exceed the storm water runoff rate from the area in its natural undeveloped state.
   (B)   The storm water runoff rate shall not exceed the available capacity of the downstream drainage system. Existing natural waterways in a subdivision shall be preserved or improved as part of the storm water drainage system.
   (C)   Easements necessary for the storm water drainage system shall be provided by the subdivider for portions of the storm water drainage system not included within a street right of way.
   (D)   If any existing natural waterways, swales, creeks, or storm sewer systems will become overburdened with storm water because of any proposed new subdivision or development, then the subdivider will be required to construct "on site" improvements consisting of the following:
      1.   A "storm water detention area" shall be constructed on property of the subdivision or development that will ensure that peak storm water runoff flow rates after development are not in excess of those that prevailed prior to said subdivision or development.
      2.   The "storm water detention area" shall be self-draining so that no water pools remain after the draining process and shall drain in such a manner as to minimize the impact of the storm water on the downstream property.
   (E)   No structures shall be constructed within the storm water discharge channels or a detention area.
   (F)   The drainage line shall be installed in accordance with the plans and specifications that have been submitted by the subdivider and approved by the duly appointed village engineer.
   (G)   The subdivider shall obtain any required permits from any other agency having jurisdiction, including the Illinois environmental protection agency. (Ord. 2005-09, 12-19-2005)
