9-3-40: GOLF CARTS AND QUALIFIED NON-HIGHWAY VEHICLES:
   (A)   Annual Permit Fee: Permit for golf cart or qualified non- highway vehicle (annual): Twenty five dollars ($25.00).
   (B)   Golf Carts And Qualified Non-Highway Vehicles Permitted; Definitions: The operation of golf carts or qualified non- highway vehicles shall be permitted on streets under the jurisdiction of the Village of Roanoke and within its corporate boundaries as set forth in this section. The term "golf cart" shall have the same meaning as set forth in section 1-123.9 of the Illinois Vehicle Code, and "qualified non-highway vehicles" shall have the same meaning as set forth in section 1-168.8 of the Illinois Vehicle Code. All- terrain vehicles (ATV) (as set forth in section 1-101.8 of the Illinois Vehicle Code) and off-highway motorcycles (as set forth in section 1-153.1 of the Illinois Vehicle Code) are specifically excluded from this provision and are not permitted on streets under the jurisdiction of the Village of Roanoke and within its corporate boundaries.
   (C)   Compliance With Illinois Vehicle Code: The operation of golf carts and qualified non-highway vehicles within the Village shall be in accordance with all provisions of the Illinois Vehicle Code, including, without limitation, section 11-1426.1 thereof. All golf carts and qualified non-highway vehicles must have, at a minimum, the equipment and other items set forth in section 11-1426.1(e) of the Illinois Vehicle Code, which includes a rearview mirror, operational headlights, brake lights, and tail lights and the required reflectors.
   (D)   Permits: No person shall operate a golf cart or qualified non-highway vehicle within the Village of Roanoke without first obtaining a permit, or being listed as an additional operator under a permit, as provided herein. Permits shall expire on December 31 of each year. The cost of the permit shall be as set forth in this Code.
      1.   Applications for a permit shall be made on a form supplied by the Village, shall be executed by the applicant and each additional operator and shall contain the following:
         (a)   Name and address of applicant;
         (b)   Name of liability insurance carrier and policy number;
         (c)   The serial number, make, model and description of golf cart or qualified non-highway vehicle;
         (d)   Waiver of liability; and
         (e)   Such other information as the Village may require.
      2.   No permit shall be granted unless the following conditions are met:
         (a)   A physically handicapped applicant or operator must submit a certificate signed by a physician, certifying that the applicant is able to safely operate a golf cart or qualified non-highway vehicle on Village streets;
         (b)   The applicant must provide evidence of insurance in compliance with the provisions of the Illinois Statutes regarding minimum liability insurance for passenger motor vehicles to be operated on the roads of the State of Illinois;
         (c)   The applicant must be at least sixteen (16) years of age and possess a valid driver's license, and must provide a copy of the applicant's driver's license.
      3.   Permits may be renewed upon demonstration of compliance with the requirements for initial issuance of a permit and the payment of the permit fee.
   (E)   Additional Requirements: The following requirements shall apply to the operation of golf carts within the Village of Roanoke:
      1.   Golf carts and qualified non-highway vehicles may be operated at any time of day provided that the operator of the golf cart or qualified non-highway vehicle: a) operates the headlights and tail lights as required for all vehicles when traveling in the nighttime or early morning hours and during rainfall; and b) does not operate the golf cart or qualified non-highway vehicle at any time on Illinois Route 116 (except to directly cross Illinois Route 116), on any other State route, or on any roadway with a speed limit exceeding thirty five (35) miles per hour;
      2.   All operators must be at least sixteen (16) years of age and possess a valid driver's license; and
      3.   A Village decal evidencing that a permit has been obtained shall be displayed on the rear of the golf cart or qualified non-highway vehicle at all times.
   (F)   Violations: Any person who violates the provision of this section shall be subject to revocation of permit or nonrenewal of permit, at the discretion of the Village Board and a monetary fine of one hundred dollars ($100.00) for the first offense, two hundred dollars ($200.00) for the second offense, and three hundred dollars ($300.00) for each subsequent offense.
