(A) If an application for a building permit does not fall within the confines of the guidelines of this subchapter, the applicant may apply to the Town Council for a variance therefrom upon the forms to be provided by the Town Council, setting out the nature of the variance; further that, upon the Town Council receiving the application, it shall set the same for hearing within 30 days from the date of the filing.
(B) The Town Council, in making its decision whether or not to grant the variance applied for shall do so, solely within the confines of this subchapter, but basing the decision on its sound discretion as to whether the variance will be most beneficial to the orderly and safe growth and development of the town.
(C) The Town Council may not grant a variance to any of the requirements of the Flood Plain or Floodway District or to the flood protection grade requirements of the Floodway Fringe District without the written approval of Natural Resources.
