For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
MANUFACTURED HOME. Incorporates I.C. 22-12-1-16 and 42 U.S.C. § 5402(6), and shall mean:
(1) Any structure, transportable in one or more sections, which, in the traveling mode, is eight body feet or more in width or 40 body feet or more in length or, when erected on site, is 320 or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air-conditioning and electrical systems contained therein; except that, such term shall include any structure which meets all the requirements of this paragraph, except the size requirements and with respect to which the manufacturer voluntarily files a certification required by the secretary and complies with the standards established under this chapter; and, except that, such term shall not include any self-propelled recreational vehicle; and
(2) A home with the characteristics of a mobile home (except that, it was built after 6-15-1976) is considered to be a MANUFACTURED HOME.
MOBILE HOME. Incorporates I.C. 16-41-27-4, and shall mean any dwelling, including the equipment sold as part of the dwelling, that:
(1) Is factory assembled;
(2) Is transportable;
(3) Is intended for year-round occupancy;
(4) Is designed for transportation on its own chassis; and
(5) Was manufactured before the effective date of the Federal Manufactured Housing Construction and Safety Standards Law of 1974 (42 U.S.C. §§ 5401 et seq.).
MOBILE HOME PARK OR COMMUNITY. The placement of or incorporates I.C. 16-41-27-5; except that, for purposes of this chapter, MOBILE HOME PARK OR COMMUNITY shall mean the placement of or construction of two or more mobile homes or manufactured homes upon any tract of real estate.
