§ 150.01  UNSAFE BUILDING LAW; COMPLIANCE.
   (A)   Under the provisions of I.C. 36-7-9, there is established the Roachdale Unsafe Building Law.
   (B)   I.C. 36-7-9 is incorporated by reference. All proceedings within the Town of Roachdale for the inspection, repair and removal of unsafe buildings shall be governed by this law and if the provisions of this section conflict with the provisions of I.C. 36-7-9, then the provisions of the state statute shall control.
   (C)   All buildings or portions thereof within the town which are determined after inspection by the enforcement authority to be unsafe are declared to be unsafe buildings as well as public nuisances and shall be abated by repair, rehabilitation, demolition or removal, as directed by the enforcement authority.
   (D)   (1)   The Town Superintendent is hereby designated the enforcement authority and is authorized to administer and enforce the unsafe building law and this section.
      (2)   The Town Council is hereby designated the hearing authority for purposes of the Unsafe Building Law and this section.
   (E)   The definition of SUBSTANTIAL PROPERTY INTEREST set forth in I.C. 36-7-9-2, is incorporated by reference herein as if copied in full.
   (F)   The description of an UNSAFE BUILDING contained in I.C. 36-7-9-4 is incorporated herein.
   (G)   (1)   All work for the reconstruction, repair or demolition of buildings and other structures shall be performed in a good workperson like manner according to the accepted standards and practices in the trade.
      (2)   The provisions of the building laws, as defined in I.C. 22-12-1-3 are incorporated herein.
      (3)   An Unsafe Building Fund is established in the operating budget of the town in accordance with the provision of I.C. 36-7-9-14.
   (H)   (1)   No person, firm or corporation, whether as owner, lessee, sublessee or occupant, shall erect, construct, enlarge, alter, repair, move, improve, remove, demolish, equip, use, occupy or maintain any building or premises, or cause or permit the same to be done, contrary to or in violation of any of the provisions of this section or any other issued by the Town Council.
      (2)   Any person violating the provision of this section or I.C. 36-7-9-28, shall commit a Class C infraction for each day the violation continues.
   (I)   This section, and all ordinances supplemental or amendatory hereto, shall be known as the “Building Code of the Town of Roachdale, Indiana,” may be cited as so, and will be referred to herein as “this code”.
   (J)   The purpose of this code is to provide minimum standards for the protection of life, health, environment, public safety and general welfare, and for the conservation of energy in the design and construction of buildings and structures.
