§ 92.99 PENALTY.

   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.

   (B)   Any person found in violation of § 92.09 of this chapter shall be subject to a fine of $50 per occurrence, not to exceed $200 per day.

   (C)   (1)   The owner(s) of the real estate on which a violation of § 92.20 of this chapter has taken place shall be penalized for violation of § 92.20 of this chapter as follows:

         (a)   First violation: fine of $25;

         (b)   Second violation: fine of $50; and

         (c)   Third and subsequent violations: fine of $100 for each violation.

      (2)   Each day a violation continues after receipt of a notice of violation shall constitute a separate offense. The civil fine shall be in addition to the abatement cost recovery procedures set forth in I.C. 36-7-10.1-4.
