A. Where the Village Engineer determines that it is feasible and the Plan Commission recommends to the Board of Trustees that it is in the best public interest, sanitary sewers shall be installed by the subdivider to serve all properties in the subdivision. The plans and specifications for such improvements shall be subject to the approval of the Village Engineer and, basically, shall conform to the standards and specifications set forth in the Village ordinances for similar construction. Where it is determined that it is not feasible or desirable to install sanitary sewers, then individual septic systems for each lot may be used, provided:
1. Septic systems shall not be used on any lots of less than eighty thousand (80,000) square feet.
2. Satisfactory individual percolation tests performed by a civil engineer under the supervision of the Village Engineer shall be submitted with the preliminary plat.
3. The subdivider shall secure an IEPA permit and such other permits as may be required prior to approval of the final plat.
Where sanitary sewer mains of larger capacity than necessary to serve the subdivision as delineated in the preliminary plat are required to serve the future growth in the vicinity of the subdivision, as determined by the Boad of Trustees, the Village shall reimburse the subdivider for the difference in cost between a ten inch (10") pipe and the larger sized pipe, said larger size to be determined by the Board of Trustees.
B. Where the Village Engineer determines that it is feasible and the Board of Trustees determines that it is desirable, water distribution facilities shall be installed by the subdivider to serve all properties in the subdivision. The plans and specifications for such improvements shall be subject to the approval of the Village Engineer and, basically, shall conform to the standards and specifications set forth in the Village ordinances for similar construction.
Where water mains of larger capacity than are necessary to serve the subdivision as delineated in the preliminary plat are required to serve the future growth in the vicinity of the subdivision, as determined by the Board of Trustees, the Village shall then take appropriate action to cause the subdivider to be reimbursed for the difference in cost between an eight inch (8") pipe and the larger sized pipe, said larger size to be determined by the Village Board. Private wells shall not be permitted on any lot of less than forty two thousand (42,000) square feet excluding in the computation of the area of said lots any road easements.
Nothing in this Section shall preclude the replacement of an existing well, provided no public water supply is available. (Ord. 86-3-6, 3-19-86)
In the event the Village incurs legal or engineering expense in connection with an application to a State agency for authority to obtain additional waters from Lake Michigan, in order to provide water service to the proposed subdivision, the subdivider agrees to reimburse the Village for such costs and expenses incurred, including the cost of the proceedings.
