10-2-2-8: ACTION BY PLAN COMMISSION:
The Plan Commission shall approve or disapprove the application for preliminary approval of a plat within ninety (90) days from the date of the application or the filing by the applicant of the last item of required supporting data, whichever date is later, unless such time is extended by mutual consent. If such plat is disapproved, then within said ninety (90) days the Plan Commission shall furnish the applicant in writing a statement setting forth the reason for disapproval and specifying with particularity the aspects in which the proposed plat fails to conform to the ordinances, including Official Map.
   A.   Make Recommendations: Approve or disapprove the proposed preliminary plat and submit its written recommendations, including the recommendations of the Village Engineer and Village Attorney, to the Board of Trustees.
   B.   Advise Subdivider: If the Plan Commission finds that changes, additions or corrections are required on the preliminary plat, the Plan Commission shall so advise the subdivider. The subdivider may resubmit the preliminary plat to the Plan Commission, paying a fifty dollar ($50.00) meeting fee, for consideration at the next regular meeting.
   The resubmission of a preliminary plat shall be considered a new submission to establish the time for review.
   C.   Attendance at Plan Commission Meetings: The Plan Commission need not review a preliminary plat unless the subdivider or his authorized agent is present at the meeting, except when prior approval has been given by the Plan Commission.
   D.   Notification to Subdivider: The Plan Commission shall not be obliged to give official written notification of Plan Commission action to the subdivider.
