7-2A-1: WHEN CONNECTION IS REQUIRED TO SANITARY SEWER SYSTEM:
Except as otherwise provided below, the owners of all subdivided lots and parcels of land within the village improved with dwellings or buildings intended for occupancy by persons are hereby required to connect to the sanitary sewer system of the village, and at such time as the owner of any unimproved lot or parcel of land shall apply for a building permit for any such dwelling or building, such owner shall cause the subject parcel to be connected to the sanitary sewer system of the village and shall pay the applicable sanitary sewer system connection charges established from time to time by the village.
For any subdivided lot or parcel of land existing before July 15, 2000, there shall be no required connection to the sanitary sewer system of the village so long as all devices and structures for treating sewage located on such lot or parcel meet or exceed the minimum standards established by Lake County and accepted by the village for the continued use and operation of such devices and structures in the village. All owners of lots or parcels desiring exemption from connection requirements shall, at their expense, furnish the village clerk with a copy of the results of inspections conducted in April, May or June of each year prior to July 15 of each year, commencing July 15, 2000. Owners of lots or parcels requesting and qualifying for exemption who subsequently elect to make connection shall be liable for all associated expenses at the time of connection, including the costs of private service line extensions, a grinder pump if required, and the decommissioning of the on site individual system. The prior inclusion of such owner's lot or parcel in any special service area installing sanitary sewer shall only be deemed payment of the standard connection charge itself and not count toward payment of such associated expenses.
Any person, firm or corporation violating the provisions of this section shall be fined not more than seven hundred fifty dollars ($750.00) and each day's continued violation shall be deemed a separate offense. In addition to any fine permitted or required to be imposed hereunder, the village may seek injunctive relief to prevent an actual or threatened violation of this section, and may also seek mandatory injunctive relief to require that connection be made to the village's sanitary sewer system when such connection is not made in violation of this section, the corporate authorities finding that the village and the health, safety and welfare of its residents will be irreparably harmed by the failure to connect to the village's sanitary sewer system, and that the imposition of a fine alone is an inadequate remedy for such violations.
