7-2-9: VIOLATIONS; PENALTY:
   A.   Any person who violates, disobeys, omits, neglects or refuses to comply with or who refuses the enforcement of any provision of this chapter shall be fined not less than one hundred dollars ($100.00) nor more than seven hundred fifty dollars ($750.00) for each such offense; and a separate offense shall be deemed committed on each day during or on which the violation occurs or continues. Any owner, lessee or occupant in control of any premises in the village who violates the provisions of this chapter shall be guilty of an offense; and, any contractor or agent who, on behalf of such owner, lessee or occupant, makes an unauthorized connection to the village's water supply system or otherwise disobeys any provision of this chapter shall be deemed to have committed a separate offense.
   B.   The owner, lessee or occupant in control of any premises in the village who violates the provisions of this chapter by making an illegal connection to the village's water supply system or by drawing water illegally through an unmetered connection to the village water supply system shall be liable to the village to pay for the village's water drawn through the unauthorized connection in an amount representing the unpaid water charges that would have been paid had the water usage been properly metered and user charges paid at the then prevailing rates in the village. In such case, the daily water usage for each day of illegal connection shall be deemed equal to one residential equivalent home unit; however, if an underground irrigation system has been installed on the property, then the daily water usage for each day of illegal connection shall be deemed equal to three (3) residential equivalent home units. If in the absence of reasonable proof as to the date that the illegal connection or drawing of unmetered water began, the building official shall calculate the user charge for the period commencing one year prior to the date of discovery of the illegal connection and ending on the date that the connection is properly metered. Failure to pay the user charges within thirty (30) days after written notification from the building official shall constitute a separate offense from the original offense first committed by making the illegal connection or drawing unmetered water, and, in such event, the provisions of sections 7-2B-4 through 7-2B-7 of this chapter shall apply.
