3-2-5: CLASSIFICATION OF LICENSES, NUMBER AND FEES:
   A.   There shall be classifications of liquor licenses authorized in the village, designated as follows:
      1.   Class A (Private Club License): The private club license shall authorize a club to sell alcoholic liquor at retail, during the hours of ten o'clock (10:00) A.M. until twelve o'clock (12:00) midnight, Monday through Thursday, and during the hours of ten o'clock (10:00) A.M. until the hour of one o'clock (1:00) A.M., on Friday, Saturday and the night prior to the major national holidays as listed below. Alcoholic beverage sale, service, and consumption shall be authorized within the property lines of the golf course operated by the club, but excluding all parking lots, sidewalks, and roadways and any portion of such golf course (other than cart paths) nearer than two hundred feet (200') to any adjoining residential lot. Outdoor alcoholic beverage sale and service from carts shall be allowed daily until the closing hour set forth in this code for outdoor club activities. The major national holidays referred to herein shall be New Year's Day; Memorial Day; Independence Day; Labor Day; Thanksgiving; and Christmas Day. The time referred to herein shall be Central Standard Time except that portion of the year, during which daylight saving time is generally in effect, and in such case the said time shall be considered to mean daylight saving time.
      2.   Class B (Park District Golf Course License): The park district golf course liquor license shall authorize the Deerfield Park District to sell alcoholic liquors at retail, daily during the hours of ten o'clock (10:00) A.M. until twelve o'clock (12:00) midnight in buildings of the said park district's golf course located within the boundaries of the Village; provided, however, that the sale of alcoholic liquors is limited to and shall be sold in connection with the operation of an established food serving facility during times when food is dispensed for consumption upon the premises, all pursuant to 235 Illinois Compiled Statutes 5/6-15.
      3.   Class C (Commercial License): A commercial license shall authorize the occasional service and/or sale of alcoholic beverages on the premises in a building whose principal use is other than the service or sale of alcoholic beverages. Said license shall not authorize the operation of a restaurant but shall be limited to sales and service on an occasional basis by a licensee who is not otherwise engaged in the sale of food or beverages.
      4.   Class D (Restaurant/Cocktail Lounge License): The restaurant/cocktail lounge liquor license does and shall authorize the retail sale of alcoholic liquor by a restaurant with an on the premises cocktail lounge, to customers or guests only, for consumption anywhere within the building, during the hours of eleven o'clock (11:00) A.M. until one o'clock (1:00) A.M. daily and until two o'clock (2:00) A.M. on New Year's Eve/Day. The restaurant/cocktail lounge liquor license shall permit the incidental retail sale of packaged beer, liquor and wine in their unopened original containers for off premises consumption within the hours prescribed for sale of beer, liquor and wine on the premises. No display area or advertising of package liquor sales are permitted.
      5.   Class E (Hotel Amenity License): The hotel amenity license does and shall authorize, the retail sale, during the hours of eleven o'clock (11:00) A.M. until eleven o'clock (11:00) P.M., seven (7) days per week, of beer and wine by bottle or can only, by a hotel to registered hotel guests or event participants only, for consumption anywhere within the hotel building; provided that the point of sale shall be limited to the lobby check in desk, the breakfast room or the meeting room of the hotel, all beer and wine shall be sold in unopened original containers, and such beer and wine, except when dispensed to registered hotel guests or event participants, shall be kept in a locked, chilled refrigerator case, access to which is restricted to the front desk attendant on duty at the hotel.
      6.   Class F (Restaurant License): The restaurant liquor license does and shall authorize the retail sale of alcoholic liquor by a restaurant to customers or guests only for consumption anywhere within the restaurant (or in an outside dining area adjacent to the restaurant when such outdoor dining has been authorized by an outdoor dining permit), during the hours of eleven o'clock (11:00) A.M. until ten thirty o'clock (10:30) P.M. Sunday through Thursday, eleven thirty o'clock (11:30) P.M. Friday and Saturday, and one o'clock (1:00) A.M. on New Year's Eve/Day. The issuance of a Class F license does not assure the issuance of an outdoor dining permit.
         a.   The restaurant liquor license shall permit the incidental retail sale of packaged beer, liquor and wine in their unopened original containers for off premises consumption within the hours prescribed for sale of beer, liquor and wine on the premises. No display area or window advertising of package liquor sales are permitted; however a temporary window poster (not exceeding eleven (11) by seventeen (17) inches) may be displayed to give notice of periodic wine and spirit tastings or dinners where the guests will be permitted to purchase wine and spirits.
         b.   Class F licensees shall sell alcoholic liquor in original packages for off-premises consumption at a cash register designated for the sale of such alcoholic liquor and which is operated by a person of at least twenty-one (21) years of age. The Class F license requires the licensee to operate both the restaurant and retail sales area of the restaurant. The licensee shall not assign the privilege to operate the retail sales area. For purposes of a Class F license, the term "incidental retail sale" means that not more than ten percent (10%) of of the gross area of the licensed premises is used for the retail sales area.
         c.   Class F licenses shall permit the tasting of samples of beer, wine, and alcoholic spirits, permitted to be sold under this classification, on the licensed premises during authorized hours of business. Licensees may charge patrons participating in a tasting event. Licensees shall not provide more than three (3) free samples, each of which shall not exceed one (1) fluid ounce for wine, two (2) fluid ounces for beer, and one-quarter (0.25) fluid ounce for alcoholic spirits, to any person in a day. Licensees must have at least one (1) BASSET-certified site manager on-premises whenever offering wine, beer, or alcoholic spirits for tasting. Licensees must provide food service when offering wine, beer, and/or alcoholic spirits for tasting.
         d.   It shall be unlawful for a Class F licensee to sell a single container of beer in its original package unless the volume of the container is greater than or equal to ten (10) ounces or two hundred ninety-five (295) milliliters. It shall be unlawful for a Class F licensee to sell a single container of an alcoholic spirit in its original package unless the volume of the container is greater than or equal to two hundred (200) milliliters.
      7.   Class G (1 Day License): The Village President may, at his discretion upon proper application, issue a one (1) day license authorizing the retail sale or dispensing of alcoholic liquor on the premises for a period of not more than one (1) day. Said license shall authorize the sale or dispensing of liquor for consumption on the premises during the hours of eleven o'clock (11:00) A.M. until one o'clock (1:00) A.M. or until two o'clock (2:00) A.M. on New Year's Eve/Day. The daily fee for such license shall be as set forth in the fee schedule. No daily license shall be issued for any premises not zoned for commercial uses.
      8.   Class H (Restaurant Beer License): The restaurant beer license does and shall authorize, the retail sale, during the hours of eleven o'clock (11:00) A.M. until nine o'clock (9:00) P.M., Monday through Thursday, and eleven o'clock (11:00) A.M. until ten o'clock (10:00) P.M., Friday, Saturday and Sunday, of beer by a restaurant, to customers only, for consumption anywhere within the restaurant only. No retail sale of beer for off premises consumption shall be allowed.
      9.   Class I (Liquor Store License): The liquor store license shall authorize the retail sale of packaged alcoholic liquor, but not consumption on the premises where sold, in a store, establishment or facility in which the retail sale of alcoholic liquor is the primary and principal business thereof, during the hours of ten o'clock (10:00) A.M. until nine o'clock (9:00) P.M., Monday through Saturday.
      10.   Class J (Cultural Center License): The cultural center liquor license does and shall authorize the retail sale and dispensing of alcoholic liquor by a cultural center or a caterer at the cultural center for on premises consumption to members, guests and, if a special use has been granted for a private dining facility, for private dining event patrons. Hours of sale under this license classification shall be those set forth in the regulations governing the use of a cultural center in the B-2 Business Compatible District (title 9, chapter 5, article F of this Code) and in any ordinance granting a special use for a private dining facility. A cultural center may also sell packaged goods of Estonian origin for off premises consumption to its members only.
      11.   Class K (Terminal Operator License). For purposes of this subsection, the terms "terminal operator" shall have the meaning set forth in the Video Gaming Act of the State of Illinois. The terminal operator liquor license does and shall authorize the retail sale and dispensing of alcoholic liquor by a terminal operator to customers only for on- premises consumption during the hours of nine o'clock (9:00) A.M. until one o'clock (1:00) A.M. Monday through Saturday, and on Sunday, from eleven o'clock (11:00) A.M. until midnight (12:00) A.M. The annual fee for such liquor license shall be as set forth in the fee schedule.
      12.   Class L1 (Automobile Convenience Store Limited License): The automobile convenience store limited license shall authorize the retail sale of packaged beer and wine only (e.g., the original manufacturer sealed and labeled container), but not consumption on the premises where sold, in a convenience store accessory to an automobile service station, subject to the following conditions:
         a.   Premises must have a state license for a filling station where gasoline or other fuel is provided for motor vehicles.
         b.   Total display area for beer and wine, including floor sale area and cooler or display case, shall not exceed ten percent (10%) of the total square footage of the building.
         c.   No sale of alcoholic beverage shall be allowed from a drive-in window or other similar opening in the licensed premises to any patron who is occupying a motor vehicle at the time of sale.
         d.   No sale of alcoholic beverage shall be allowed between the hours of 2:00 a.m. and 8:00 a.m. on any given day.
      13.   Class L2 (Automobile Convenience Store Full License): The automobile convenience store full license shall authorize the retail sale of packaged alcoholic liquor (e.g., the original manufacturer sealed and labeled container), but not consumption on the premises where sold, in a convenience store accessory to an automobile service station, subject to the following conditions:
         a.   Premises must have a state license for a filling station where gasoline or other fuel is provided for motor vehicles.
         b.   Total display area for beer and wine, including floor sale area and cooler or display case, shall not exceed ten percent (10%) of the total square footage of the building.
         c.   No sale of alcoholic beverage shall be allowed from a drive-in window or other similar opening in the licensed premises to any patron who is occupying a motor vehicle at the time of sale.
         d.   No sale of alcoholic beverage shall be allowed between the hours of 2:00 a.m. and 8:00 a.m. on any given day.
   B.   The maximum number of liquor licenses under each classification which may be issued at any time is limited as set forth below; provided, that if any one (1) of the licenses of a given classification shall not then be currently issued or if such license shall lapse, be revoked or terminated in any manner, the Board of Trustees may reduce the maximum number of licenses authorized for the classification.

   C.   The annual fee for such license classification shall be as set forth from time to time in the fee schedule and shall be payable in full in the month in which application is first made for such license and on January 1 of each year. Any liquor license issued herein shall become null and void unless all license fees due under this chapter are paid in full when due.
   D.   The hours of operation when the sale of alcoholic liquor is allowed shall be based on Central Standard Time, except for the portion of the year when daylight saving time is in effect, in which case the time shall be based on daylight saving time.
