9-1-2: REMOVAL OF ABANDONED, UNATTENDED AND ILLEGALLY STOPPED VEHICLES:
   (A)   No person shall abandon any motor vehicle or any part thereof on any street or highway in the Village, or on private or public property in view of the general public, except on property of the owner or bailee of such abandoned vehicle, or on the premises of a place of business licensed to engage in the repair, wrecking or junking of motor vehicles.
   (B)   No person shall leave any inoperable motor vehicle on any street or highway in the Village for any length of time, or on private or public property for a period of thirty (30) days or more.
   (C)   The activities described in subsections (A) and (B) of this section are declared a nuisance within the Village, and the Village Manager, or any person that he/she may designate, shall be authorized to abate such nuisance, under the authority as provided in this Code.
   (D)   The Chief of Police or any member of the Police Department so designated by him may authorize the removal of any abandoned or inoperable motor vehicle on private or public property, after a waiting period of at least seven (7) days has expired. Prior to the removal of a motor vehicle under this section, an attempt to provide notice to the registered owner, if known, of the motor vehicle, if known, shall be given in writing. Motor vehicles inoperable or abandoned on any public way so as to present a hazard or which otherwise impede traffic may be removed pursuant to section 9-7-3 of this Code without notice.
   (E)   All persons are required to dispose of any abandoned or inoperable motor vehicles under their control upon written notice received from the Village or from the Chief of Police or any member of the Police Department commanding such disposition of the abandoned or inoperable motor vehicle.
   (F)   The owner of the motor vehicle removed under this subsection shall be subject to towing and storage fees and penalties that may be assessed by the Village or a court of law. (Ord. 2960, 7-20-2017)
