7-2-13: COMPANIES LICENSED FOR REMOVAL OF CONSTRUCTION WASTE:
   (A)   No person or company shall provide construction waste removal services without first receiving a license from the village.
   (B)   Each company shall pay an annual fee of three hundred dollars ($300.00) to be licensed under this section.
   (C)   All companies providing construction waste removal services shall be subject to the following standards and requirements:
      1.   Equipment:
         (a)   The company shall use modern equipment.
         (b)   Equipment used to perform any services under this chapter shall be properly licensed by the state of Illinois and conform to all applicable safety standards.
         (c)   The appearance and sanitary condition of collection vehicles and other equipment will be maintained to high standards by cleaning, washing, painting and disinfecting as necessary. All equipment operated by the company will be in good repair at all times.
         (d)   The company shall not store, or allow to be stored, any equipment or materials on private property except in strict compliance with applicable village ordinances.
      2.   Care And Disposition Of Materials:
         (a)   All waste collected by the company shall be removed from the village no less frequently than once per week during construction and within twenty four (24) hours after completion of construction and transported to a facility designated or approved by the state in which it is located.
         (b)   The company shall not cause or contribute to litter in the process of making collections.
         (c)   All materials collected by the company shall be so contained, secured or enclosed during collection and transportation so that leaking, spilling or blowing is prevented.
         (d)   The company shall immediately clean up and remediate all litter, blowing debris, spills and releases of any material over which it exercises control occurring prior to the delivery of the material to its intended destination.
      3.   Insurance:
         (a)   The company shall at all times during its performance of services within the village maintain in full force and effect employer's liability, workers' compensation, public liability and property damage insurance, including contractual liability coverage. Certificates or other evidence of such insurance shall be furnished by the company to the village prior to the village's issuance of a license to the company. The company shall carry the following types of insurance in at least the limits specified below:
Workers' compensation   Statutory as amended from time to time
   Employer's liability    $500,000.00
   Bodily injury liability   $500,000.00 each occurrence
   Except automobile   $1,000,000.00 aggregate
   Property damage liability   $500,000.00 each occurrence
   Except automobile   $1,000,000.00 aggregate
   Automobile bodily injury   $1,000,000.00 each person
   Liability   $3,000,000.00 each occurrence
   Automobile property damage   $500,000.00 each occurrence
   Excess umbrella liability   $5,000,000.00 each occurrence
         (b)   Said insurance policies shall provide that they cannot be canceled without thirty (30) days' prior written notice to the village. The company shall furnish the village with certificates evidencing that the insurance provided for herein is maintained by the company.
         (c)   The company shall also provide a bond in favor of the village in an amount of no less than ten thousand dollars ($10,000.00) to secure the repair of any damage to village property caused by the company. (Ord. 2393, 1-21-2002)
