No person, unless licensed for garbage hauling by the village, shall drive through the public streets, ways or alleys of the village any vehicle which contains refuse, garbage, or any other substance which emits a foul or disagreeable smell or odor, to the annoyance and discomfort of any of the residents of the village or the public. Violation of this section shall, without prejudice to the penalty hereinafter provided, also constitute a nuisance, which may be abated as such, and the vehicle and the contents thereof be removed beyond the corporate limits of the village by any police officer, or any member of the village's building department.
