6-1-12: AMUSEMENT DEVICES:
   (A)   Definitions: As used in this section, the following terms are thus defined:
    COIN OPERATED AMUSEMENT DEVICES: Any skill ball machines, target shooting machine, mechanical grab machine, foosball machine, disk bowling machine, air hockey machine, and any other similar mechanical or electronic amusement machine or device which may be operated by the public generally upon the insertion or deposit of a coin, slug, or other token, and which returns to the player thereof no money or property or right to receive any money or property.
   NOT FOR PROFIT: An organization which satisfies the definition under section 501(c)(3) of the internal revenue code.
   PINBALL, BAGATELLE OR PIGEONHOLE GAME: A game played with any number of balls upon a table or board having holes or cups into which such balls may drop or become lodged, and having arches, pins or springs or any of them to control, deflect or impede the direction of the balls when put in motion by the player and shall include any of the games commonly known as "pin games".
   PLACE OF PUBLIC RESORT: Any premises wherein any service or merchandise is offered for sale to the public, or where any table or implement for the playing of any pinball, bagatelle, pigeonhole or other coin operated amusement device is kept for profit, or any premises used as a clubhouse or clubroom; but such term shall not include any place set aside or provided for organized recreational activities or youth recreational activities under the ownership, control or supervision of a public municipal or not for profit organization engaged in conducting or administering such recreational activities within the village.
   SIMULATED VIDEO GAMING DEVICES: Video poker machine, video slot machine, video bingo machine, and other device which involves any game or amusement based upon poker, blackjack, dog racing, or horseracing, craps, any card or dice game, or any similar amusement machine or device operated by means of the insertion of a coin, token, currency or similar object.
   (B)   Amusement Devices Prohibited: No person, firm or organization shall keep or use in any place of public resort in the village any table or implement for any pinball, bagatelle or pigeonhole game or for any other coin operated amusement devices, nor shall any person, firm or organization permit the playing of any such game or amusement device in any such place of public resort.
   (C)   Seizure Of Devices: It shall be the duty of any police officer of this village to seize any table or implement kept or used in violation of this section, and upon conviction of the keeper thereof, any such table or implement so seized shall be destroyed.
   (D)   Exception, Nonprofit Organizations: Coin operated amusement devices may be kept and used in a place set aside under the ownership, control or supervision of a public- municipal or not for profit organization engaged in conducting or administering organized recreational activities in the village, provided that:
      1.   Said devices are part of (and not the primary implements of) an organized public recreational program or activity conducted in the village.
      2.   No more than three (3) such devices shall be permitted, kept and used for organized recreation programs or activities in the village by any one organization.
      3.   All net proceeds received from the use and operation of such devices shall be used to support the public or youth recreational programs of the organization concerned.
   (E)   License Required: No public-municipal or not for profit organization engaged in conducting or administering organized public recreation activities or programs within this village shall keep or use any coin operated device within this village without first obtaining a license therefor from the village manager and paying a license fee of ten dollars ($10.00) per each device. Such license shall be issued on an annual basis, expiring on December 31 of each year of issuance and shall be nontransferable. No portion of the license fee shall be proratable.
   (F)   Simulated Video Gaming Devices Prohibited: Notwithstanding any provision herein to the contrary, it shall be unlawful for any person, firm or corporation to locate, maintain or operate within the village any simulated video gaming device. (Ord. 2215, 3-3-1998)
