(A) Every cistern within the limits of the village shall be kept securely covered. Every person who shall suffer or permit any cistern to remain uncovered upon any premises owned or controlled or occupied by him in the village shall be deemed guilty of maintaining a nuisance.
(B) No well shall be created within the limits of the village after May 1, 2013.
(C) No well within the limits of the village, regardless of when created, shall be used as a source of potable water, for irrigation, or for any other purpose after May 1, 2013. Wells existing within the village limits as of May 1, 2013, shall only be allowed to remain if securely capped and covered to prevent use.
(D) The penalty for a violation of this section shall be not less than one hundred dollars ($100.00) and not more than seven hundred fifty dollars ($750.00), with each day a violation exists constituting a separate offense. (Ord. 2815, 4-1-2013)
