5-2-11: REIMBURSEMENT FOR SPECIALIZED RESCUE SERVICES:
   (A)   Definitions: For purposes of this section, the following definitions shall apply:
    RESPONSIBLE PARTY: Any of the following parties who have been found at fault by the Occupational Safety and Health Administration or the Illinois Department of Labor:
1.The owner of the property on which the specialized rescue services occurred;
2.Any person involved in an activity that caused or contributed to the emergency;
3.An individual who is rescued during the emergency and his or her employer if the person was acting in furtherance of the employer's interests;
4.In cases involving the recovery of property, any person having control or custody of the property at the time of the emergency.
   SPECIALIZED RESCUE SERVICE: Includes, but is not limited to, structural collapse, tactical rescue, high angle rescue, underwater rescue and recovery, confined space rescue, below grade rescue, and trench rescue.
   (B)   Reimbursement: As reimbursement for specialized rescue services provided by the Riverside Fire Department, a responsible party may be charged any and all of the following fees, where applicable:
      1.   For each emergency response vehicle: One hundred twenty five dollars ($125.00) per hour.
      2.   For each specialized rescue service team member: Thirty five dollars ($35.00) per hour.
   (C)   Liability: In the event there is more than one responsible party, each responsible party shall be jointly and severally liable for any and all charges incurred under this section.
   (D)   Failure To Reimburse Charges: Any person or entity that, after sixty (60) days' notice of the charge, has failed to pay the charges assessed under subsection (B) of this section shall be deemed to have violated this section and will incur a fine of not less than one hundred dollars ($100.00) nor more than five hundred dollars ($500.00) for each offense, plus all legal fees and other costs of enforcement and collection. Each day that a violation continues shall constitute a separate offense.
   (E)   Other Charges Not Precluded: Nothing in this section shall preclude the assessment of fees or other charges pursuant to any other district ordinance, resolution, or provision of this Code. (Ord. 2703, 3-16-2009)
