A structure as defined in section 4-12-1
that is located in the public right of way adjacent to private property in violation of subsection 8-13-1
(A), shall be removed from the public right of way unless the conditions established in section 4-12-3
of this chapter are satisfied, or where the owner of the property adjacent to the public right of way has previously obtained a hardscape permit pursuant to section 8-13-1
