Any owner who fails to furnish heat as provided in this Chapter and which affects no more than three (3) apartments or other such units in the same building, shall, upon conviction thereof, be subject to a fine of not less than one hundred dollars ($100.00) plus court costs for the first such offense, not less than one hundred fifty dollars ($150.00) plus court costs for the second such offense, and not less than two hundred fifty dollars ($250.00) nor more than seven hundred fifty dollars ($750.00) plus court costs for each subsequent offense during the same September 15 to June 1 heating period. Any owner who fails to furnish heat as provided in this Chapter, and which affects more than three (3) apartments or other such units in the same building shall, upon conviction thereof, be subject to a fine of not less than two hundred fifty dollars ($250.00) plus court costs for the first such offense, not less than five hundred dollars ($500.00) plus court costs for the second such offense, and not less than seven hundred fifty dollars ($750.00) plus court costs for each subsequent offense during the same September 15 to June 1 heating period. Each and every day that the owner is in violation of the heating requirements of this Chapter shall constitute a separate offense for the purposes of this Section. (Ord. 2270, 1-18-1999)
