1-5-12: INDEMNIFICATION:
If any claim or action is instituted against an officer or employee of the village based on an injury allegedly arising out of an act or omission occurring within the scope of his or her service or employment as an officer or employee, the village shall do any one or more of the following as appropriate:
   (A)   Appear and defend against the claim or action;
   (B)   Indemnify the officer or employee for his or her court costs incurred in the defense of such claim or action;
   (C)   Pay or indemnify the officer or employee for a judgment based on such claim or action; and/or
   (D)   Pay or indemnify the officer or employee for a compromise or settlement of such claim or action.
Such indemnification shall not apply to any portion of a judgment representing an award of punitive or exemplary damages. This section shall be interpreted to the full extent of section 2-302 of the tort immunity act. To the extent authorized by that statute, it shall apply to claims or actions against former officers and employees. (Ord. 2337, 6-19-2000)
