(A) No Manufacturing Or Bottling: Except for alcoholic liquor manufactured by a licensed craft distillery, or beer manufactured by a licensed brewpub or microbrewery, no alcoholic liquor intended for sale shall be manufactured or bottled within the Village. (Ord. 2908, 5-5-2016)
(B) No Sale Or Consumption On Unlicensed Premises: No liquor shall be sold, offered for sale, kept for sale, displayed or advertised for sale at retail or delivered to any person purchasing same at retail except at a location, place or premises described in a retail liquor license or permit. It shall be unlawful for anyone not having a license or permit providing for consumption on the premises where sold, to offer for sale, sell or donate any alcoholic beverage for consumption on any premises open to the general public, or to permit the same to be consumed where sold or donated. (C) No Possession Or Consumption In Public Places: No person shall open any container of alcoholic liquor, or have in his possession any open container of alcoholic liquor, or consume any alcoholic liquor in or upon any street, park, public way, public sidewalk, public parking lot or public school, or in any public building owned by the Village or other governmental entity unless a special permit has been obtained as otherwise provided for in this chapter for use of such public building.
(D) No Sale In Public Buildings: No alcoholic liquor shall be sold or delivered in any public building owned by or under the control of the Village or other governmental entity except pursuant to the issuance of a special permit as herein provided for in this chapter. (Ord. 2143, 2-4-1996)
(E) No Sale Or Delivery To Minors And Intoxicated Persons: No person shall sell, give or deliver alcoholic liquor to any person under the age of twenty one (21) years except in the performance of a religious ceremony or service, or sell, give or deliver alcoholic liquor to any intoxicated person or to any person known to be a habitual drunkard, or insane, or mentally ill. Nor shall any owner, lessee or occupant of any premises located within this Village knowingly allow any person under the age of twenty one (21) to possess, dispense or consume alcoholic liquor on said premises, except where pursuant to a religious service or ceremony in an established church or where said owner, lessee or occupant is the parent of such minor and is exercising direct supervision and approval over the possession, dispensing or consumption of alcoholic liquor by the minor in the privacy of the minor's home. (F) No Advertising: No sign or advertisement of any alcoholic liquor shall be placed upon or outside any building in the Village, except as herein provided for in title 4, chapter 3, "Signs", of this Code, with respect to the retail sale of alcoholic liquor by a holder of a Class A, C or E liquor license in this Village. (G) No Peddling: No person shall peddle alcoholic liquor in the Village.
(H) No Purchase, Sale And/Or Use Or Consumption By Minors: No person under the age of twenty one (21) years shall purchase, sell, accept a gift or delivery of or have in his possession any alcoholic liquor, nor consume the same in this Village except where pursuant to a religious service or ceremony in an established church or under direct parental supervision and approval in the privacy of a home.
(I) No Sales Near Churches, Schools Or School Supply Stores: Except as herein provided for permitted church sponsored functions, no person shall sell at retail, and no liquor license shall be issued, for the sale of alcoholic liquor within one hundred feet (100') of any church or school or for the sale of any alcoholic liquor at any store or other place of business where the majority of customers are minors of school age or where the principal business transacted consists of schoolbooks, school supplies, food, lunches or drinks for such minors. (J) BASSET Training: The licensee, each on site manager and all sales, waitstaff and other employees engaged in the selling, serving or delivery of alcoholic beverages to customers, guests or patrons, for consumption on or off the premises, shall take and successfully complete a Beverage Alcohol Sellers and Servers Education and Training (BASSET) Program that has been certified by the State of Illinois. A copy of the BASSET course completion certificate(s) for each such person shall be made available at all times at the licensed premises for inspection by the Local Liquor Control Commissioner, or his or her designee.
