3-2-1: DEFINITIONS:
The following definitions shall apply in the interpretation and enforcement of this chapter:
ALCOHOLIC LIQUOR: Any malt, vinous, mixed or fermented liquor suitable for beverage purposes containing more than one-half of one percent (0.5%) of alcohol by volume.
APPLICANT: Any person, firm, partnership or organization making application for a local retailer's liquor license as provided in this chapter.
BEER: A beverage obtained by alcoholic fermentation of an infusion or concoction of barley, or other grain, malt and hops in water, and includes among other things, beer, ale, stout, lager beer, porter and the like.
BOTTLE: Wherever the verb "bottle" is used herein in connection with such alcoholic liquor, it shall refer to and include the packing thereof in bottles or other containers for sale at retail.
BREWPUB: A full service restaurant that also serves alcoholic beverages, and which includes the on-site manufacture, storage and retail sale of beer for consumption on or off the designated premises. A brewpub may also offer for sale at retail, for use and consumption on the licensed premises, any alcoholic liquor purchased from a licensed distributor or importing distributor.
CRAFT BEER: A beer made by an American craft brewer that: a) has an annual production of six million (6,000,000) barrels of beer or less (beer production is attributed to the rules of alternating proprietorships); b) less than twenty five percent (25%) of the craft brewery is owned or controlled (or equivalent economic interest) by a beverage alcohol industry member that is not itself a craft brewer; and c) has a majority of its total beverage alcohol volume in beers whose flavor derives from traditional or innovative brewing ingredients and their fermentation. Flavored malt beverages are not considered craft beers.
CRAFT DISTILLERY: A facility for on site production and storage of alcoholic liquor beverages, including specifically spirits and wine, in quantities not to exceed the number of gallons authorized for production each year by a craft distillery and limited wine manufacturer in the Liquor Control Act of 1934, and which includes an accessory tasting room and/or retail outlet at which customers may consume and/or purchase products manufactured on site for on or off premises consumption and purchase related sales items. Sales of food and nonalcoholic beverages are permitted, but the sale or consumption of alcoholic liquor manufactured outside of the facility is prohibited.
LICENSE: The word "license" or "liquor license" shall include and refer to that specific grant of a privilege authorizing a license to sell or offer for sale alcoholic liquor at retail only in the manner set forth in the wording of the license classification itself as well as in compliance with the rules and regulations set forth in this chapter.
LICENSEE: That person granted the privilege by the Corporate Authorities of this Village to engage in the retail sale of alcoholic liquor.
MICROBREWERY: A facility for on site production and storage of craft beer in quantities no less than one hundred (100) barrels per year and no more than fifteen thousand (15,000) barrels per year, that may include an accessory taproom and/or retail outlet where customers may consume and/or purchase products manufactured on site for consumption either on site or off site and also purchase related sales items. Sales of food, craft beers, craft cider and wine manufactured off site, and nonalcoholic beverages are permitted, but sales of any other alcoholic beverages manufactured off site are prohibited. Sales of craft beer manufactured on site must constitute at least fifty percent (50%) of all craft beer sales annually. Sales of craft beer manufactured on site may also be made to importing distributors or distributors in accordance with the Liquor Control Act of 1934.
ORIGINAL CONTAINER: Any bottle, flask, jug, can, barrel, keg, hogshead, container, or other receptacle whatsoever, used, corked or capped, sealed and labeled by the manufacturer of alcoholic liquor to contain and to convey any alcoholic liquor.
PERSON: A natural person or persons, firm or corporation.
RESTAURANT: Any public place kept, used, maintained, advertised and held out to the public as a place where meals are served, and which offers patrons a luncheon and/or dinner menu.
SELL, SALE: Wherever the word "sell" or the noun "sale" is used herein with respect to such alcoholic liquor, it shall include and refer to the transfer, barter or exchange thereof in any manner or by any means whatsoever and includes all sales made by any person, whether principal proprietor, agent, servant or employee.
