(a) Whoever violates § 438.33 shall be guilty of a minor misdemeanor.
(b) Whoever violates § 438.34 shall be guilty of a minor misdemeanor on the first offense, a fourth degree misdemeanor if the offender has been previously convicted of a violation of § 438.34 within the last 12 months and third-degree misdemeanor if the offender has been previously convicted of two or more violations of § 438.34 within the 12 months.
