§ 32.053 MEMBERSHIP OF BOARD.
   (A)   Members. The Board shall consist of five members who are residents of the area served by the Board, and are to be appointed as follows:
      (1)   Three members are to be appointed by the Mayor.
      (2)   Two members are to be appointed by the Common Council.
   (B)   Term. The terms of the members may not exceed four years, and the initial terms shall be staggered as follows:
      (1)   Two members shall be appointed for four year terms ending December 31, 1999.
      (2)   One member shall be appointed for a three year term ending December 31, 1998.
      (3)   One member shall be appointed for a two year term ending December 31, 1997.
      (4)   One member shall be appointed for a one year term ending December 31, 1996.
   (C)   Compensation. Each member shall be entitled to receive such salary and reasonable expenses as the Common Council may determine, provided however, that no member shall receive a greater compensation than the highest paid elected official of the city.
   (D)   Chairman. The Board shall select from its members a chairman who shall not be considered the head of a department for purposes of IC 36-4-9-2.
