(A) Prior to the issuance of any right-of-way work permit, the utility or broadband service provider must comply with the following requirements:
(1) The utility or broadband service provider, and any contractor or agent performing work on their behalf, must execute the agreement for the issuance of a right-of-way work permit;
(2) Construction plans must be submitted to the city's Project Manager and Street Commissioner for review and approval;
(3) The utility or broadband service provider, and any contractor or agent performing work on their behalf, must submit proof of insurance to the city's Project Manager and Street Commissioner and the city must be named as an additional insured;
(4) The right-of-way work permit fee in the amount of $100 must be paid to the city's Clerk-Treasurer office. This fee may be waived for the installation of broadband services as part of the "Broadband Ready Communities" initiative as outlined in I.C. 5-28-28.5; and
(5) The posting of any sureties or bonds which may be required by the city's Project Manager and Street Commissioner.
