§ 99.01 AUTHORITY; PERMIT REQUIRED; EXEMPTION.
   (A)   The City of Rising Sun, Indiana (the "City) is granted the authority in the Indiana Code to regulate the usage of public rights-of-way through various statutes including, but not limited to, I.C. 36-8-2-10 which authorizes the city to regulate the operation of businesses, crafts, professions, and occupations, and I.C. 36-9-2-15 which authorizes the city to regulate the furnishing of utility service to the citizens of the city.
   (B)   Any "utility", as defined by I.C. 8-1-2-1(g), and any company offering "broadband services", as defined by I.C. 5-28-28-0.5, shall be required to obtain a right-of-way work permit from the city prior to the installation of any utility infrastructure in city rights-of-way.
   (C)   A permit is not required for the installation of any utility infrastructure by the Rising Sun Municipal Utilities ("RSMU") and the RSMU is hereby exempted from requirements of this chapter.
