Horse-drawn carriage businesses shall be operated only in accordance with the following regulations:
(A) A copy of the horse-drawn carriage license shall be carried by the coach person or in the coach. The Clerk-Treasurer upon issuance of the license shall issue that number of duplicates as requested in the application identifying each carriage identified in the application.
(B) Each carriage shall be operated by a holder of a valid Indiana drivers license issued pursuant to state statute and shall have such license on his person at all times when operating such vehicle.
(C) When carrying persons for hire or by contract, the vehicle shall be operated only upon the
routes and during the hours approved by the Chief of Police, which approval shall not be unreasonably withheld.
(D) Horse-drawn carriage shall pick up and discharge passengers only upon the curb lanes while lawfully parked at the curb.
(E) Except when picking up or discharging passengers, horse-drawn vehicles shall park only in “stands” designated in the approved route application for designated horse-drawn carriage stands approved by the City Council and so marked.
(F) Horse-drawn vehicles, when in motion, shall be operated only in the curb most traffic lane on any public street and the driver shall obey all applicable state and local traffic laws, ordinances and regulations.
(G) No horse-drawn vehicle shall be operated on a public street unless a valid bond or public liability insurance policy as specified in this chapter is on file with the Clerk-Treasurer.
(H) Rates shall be prominently displayed at the boarding area so as to advise prospective clientele of the rates and fares. Drivers shall carry rate cards and exhibit them upon demand. Rate cards shall bear the name and business address of the license holder, and a complete schedule of rates and fares. It shall be the responsibility of the owner to provide rate cards to all drivers.
(I) Occupancy of a horse-drawn carriage shall not exceed a total load weight of more than 1,000 pounds not including the carriage.
(J) No passengers shall be allowed to ride on any part of the vehicle which is in motion except on designated seating upon the vehicle.
(K) The driver shall not solicit patronage in a loud tone of voice or in any manner to annoy or to obstruct the movement of a person, or follow any person for the purpose of soliciting patronage.
(L) The horse may not be allowed to exceed a walk while working in the city with the exception of a route as designated, approved and determined by the Chief of Police so as not to hinder the flow of traffic.
