(A) The owner of a vehicle that has been tagged pursuant to § 90.18 of this chapter may request to appear before the Common Council of the city by notifying the Clerk-Treasurer of the city, in writing, of their desire to appear before the Common Council to offer an explanation as to the abandoned vehicle.
(B) Said written request to appear before the Common Council must be provided to the Clerk-Treasurer within 72 hours of the abandoned vehicle being tagged.
(C) Upon receiving a written request by the owner of an abandoned vehicle, the Police Department will take no action under this chapter until such time as the owner of the abandoned vehicle has the opportunity to appear before the Common Council.
(D) The Common Council may, in their complete discretion, grant the owner of the abandoned vehicle additional time to remedy the violation of the ordinance.
(E) Reasons that an additional time may be granted include, but are not limited to, the following:
(1) The owner of the abandoned vehicle is in the process of, and has obtained a building permit to; construct a structure which will house the abandoned vehicle;
(2) The owner of the abandoned vehicle is in the process of constructing a fence around the property which will conceal the abandoned vehicle; and/or
(3) The owner of the abandoned vehicle is in the process of restoring the abandoned vehicle and the owner of the abandoned vehicle can prove said restoration by providing receipts and/or any additional information necessary to show that the abandoned vehicle is being restored.
(F) If no additional time is granted to the owner of the abandoned vehicle by the Common Council, the Police Department shall enforce this chapter as written.
