§ 55.02 STATEMENT OF POLICY.
   (A)   It is the policy of the city of Rising Sun, the RSMU and its Board to provide for the orderly growth and expansion of the Rising Sun Municipal Utility water and wastewater (sanitary sewer) services.
   (B)   All improvements to the Rising Sun water and wastewater (sanitary sewer) service systems shall be constructed in accordance with specifications adopted by the Rising Sun Municipal Utility Service Board.
   (C)   The construction of Minor Improvements shall be at the sole cost of the applicant for water and/or sewer service. The Board, at its sole discretion, may require an increase in the capacity of all or part of the improvements when such increase capacity is consistent with the adopted Wastewater and Water Master Plans. Only the incremental cost associated with the increase capacity requirements specified by the Board shall be paid by the Rising Sun Municipal Utility. Nothing contained herein shall be construed to require the Board to increase the capacity of the proposed Minor Improvements.
   (D)   The construction of Major Improvements shall be at the sole discretion of the Board subject to planning considerations and finance availability. Major Improvements made to the water or wastewater systems may be paid with revenue generated by all customers of the utility upon approval of the Board.
   (E)   The Rising Sun Municipal Utility Service Board may approve the extension of water and wastewater services outside of the City of Rising Sun's corporation limits provided that all of the following conditions are satisfied:
      (1)   The Rising Sun City Council has passed a resolution authorizing the extension of services outside of the City Limits; and
      (2)   The extension of services do not conflict with any established service areas for the services requested; and
      (3)   Both water and wastewater capacity fees are paid regardless of whether only one or the other service is being extended; and
      (4)   The water and/or wastewater service extension does not cause the water and/or wastewater utility systems to exceed their design or rated capacity; and
      (5)   The water and wastewater improvements constructed to the extension area are designed and built in compliance with Rising Sun Municipal Utility specifications and the plans are reviewed and approved by the RSMU prior to construction; and
      (6)   The proposed service area extension will be governed by the rules, regulations and ordinances that govern all RSMU customers.
   (F)   Nothing contained herein shall be construed to require the Board to approve extending water and/or wastewater service outside of the City of Riding Sun's corporation limits.
