Neither the City Municipal Utility Water Department nor the customer shall be held liable for any failure or delay in performing any of the things undertaken by the City Municipal Utility Water Department or customer under any service contract in case such failure or delay is caused by strikes, acts of God, unavoidable accidents or other contingencies beyond utility or customer control and in no manner due to any fault, neglect, or omission on the utility's or the customer's part.
