(A) (1) For purposes of this section, PER DAY shall be defined to mean each 24-hour period irrespective whether an inmate is incarcerated for the full 24-hour period.
(2) An inmate approved by the Sheriff to participate in either program shall pay an administrative fee of $100.
(3) An inmate approved for home incarceration shall pay $20 per day for each day served.
(4) An inmate approved for work release shall pay a minimum of $20 per day, or the inmates hourly wage per day, whichever is greater.
(5) An inmate approved by the Sheriff to participate in either program shall pay two weeks fees in advance of initiating said program.
(6) For an inmate who is serving a period less than 30 days, a non-refundable user fee of $250 will be assessed in addition to any other fees.
(7) For an inmate who works outside of the county, a non-refundable user fee of $200 will be assessed for those participants serving a period of less than 180 days and a fee of $400 will be assessed for those serving a term greater than 180 days.
(8) The Commissioners recognize that flexibility is required and that deviation from the fees may be appropriate in the interest of fairness and justice. Therefore, either the Sheriff, or the Director of Home Incarceration and Work Release, shall be authorized to deviate from the fees, if either believes it to be appropriate. Any and all deviations, with the reasons stated, should be recorded and included in the annual report to the Commissioners and Council.
(B) (1) There is established the following fees for participation in the Juvenile Home Detention Program:
(a) Initial installation fee: $25; and
(b) Daily fee: $8.
(2) The Juvenile Home Detention Program Fund is established.
(3) Fees when collected by the County Probation Department shall be deposited to said Fund for use by the County Probation Department in administering the Juvenile Home Detention Program.
