§ 33.067 INMATES OF COUNTY JAIL.
   (A)   (1)   The Sheriff of the county is hereby authorized to collect a fee of $2 for meals considered to be an excess of that food prepared for the noon and evening meals of inmates incarcerated in the County Jail.
      (2)   (a)   It will not be the policy of the Sheriff of the county to have an excessive amount of food prepared specifically for the purpose of feeding other than individuals designated as inmates and are in a state of incarceration.
         (b)   According to I.C. 36-8-10-7, the Sheriff of the county will account for the revenue received per meal; this accounting will be forwarded to the Auditor of the county and be maintained as provided for by the State Board of Accounts.
      (3)   The revenue collected will be placed by the Auditor of the county into a fund designated as the Sheriff’s Improvement Fund and such revenue will be utilized for payment of improvements made specifically to the infrastructure known as the County Jail.
      (4)   This section shall take effect immediately upon adoption.
   (B)   (1)   There is hereby established a housing fee of $50 per day for housing of an inmate at the County Jail for an intermittent jail sentence.
      (2)   Any person who is as follows shall reimburse the county the sum of $50 per day for each day served of an intermittent sentence:
         (a)   Sentences for a felony or misdemeanor;
         (b)   Subject to lawful detention in I.C. 35-41-1-18 in the County Jail and is ordered to serve said sentence on an intermittent basis; and
         (c)   Not detained as a child subject to the jurisdiction of a juvenile court.
      (3)   The County Sheriff shall collect the amounts due from a period under this division (B) and deposit said funds into the County General Fund.
   (C)   The Sheriff of the county, or his or her designee, is authorized to charge the inmate’s commissary account the sum of $15 for each occurrence of a doctor or dentist visit; the sum of $10 for each occurrence of a jail medical staff visit; and the sum of $3 for an origination fee for each prescription. Said amount is to be collected and deposited with the Auditor of the county for credit to the County General Fund.
