The Rigby City parks, that is all City public lands, including, but not limited to, the north and south parks, excluding the fairgrounds, shall close at eleven o'clock (11:00) P.M. until sunrise. The Chief of Police may authorize, in writing, an exception to the above restriction.
Anyone who remains or enters upon the property after eleven o'clock (11:00) P.M. and prior to sunrise shall be guilty of an infraction for the first violation with a twenty five dollar ($25.00) penalty, an infraction for the second violation with a fifty dollar ($50.00) penalty, and misdemeanor for the third and subsequent violations within a calendar year, and punished as set forth in section 1-4-1 of this Code.
