The subdivider shall hold the Village free and harmless from any and all claims for damages of every nature arising or growing out of the construction of such improvements and shall defend, at his own cost and expense, each and every lawsuit brought against said Village by reason thereof until the improvements have been approved by the Village Engineer and accepted by the Village Council.
