(a) All new houses, apartments, and other residential units having Building Permits issued after the effective date of this section shall, prior to occupancy, have at least one sidewalk, where:
(1) Sidewalk shall be located between the home and the street, and
(2) Sidewalk shall be four (4.0) feet in width, and be installed with the closest point no closer than three (3) feet from the street and with the farthest edge no further than eight (8) feet from the street, and
(3) Sidewalk shall be parallel to the street, and shall extend across the property, and
(4) Sidewalk shall be situated so as align the sidewalk of the subject property with the sidewalks (if any) of adjoining properties, and
(5) Properties located at the intersection of two streets shall have at least one sidewalk parallel to each street, where each sidewalk meets the requirements of subsections (a)(1) through (d) hereof.
(b) Sidewalks constructed or replaced after the effective date of this section shall meet the "Standard Sidewalk" specifications described in the Exhibit attached to Ordinance 11-01-13. Sidewalk concrete shall have a minimum thickness of four (4) inches, except that where a sidewalk crosses a driveway the concrete shall have a minimum thickness of six (6) inches.
(c) If owners of existing homes remove sidewalks after the effective date of this section, such sidewalks shall be replaced, where sidewalks meets the requirements of subsections (a) and (b) hereof.
(d) Each day of violation of this section shall be considered a separate offense. Whoever violates any provision of this section shall be fined not more than fifty dollars ($50.00) for each offense.
