§ 130.999 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.999 of this code of ordinances.
   (B)   The first violation of § 130.001 shall subject the offender to a fine of $100 payable in the City Clerk’s office in addition to forfeiture of the gun or other device. Any person who shall commit a second or more violation of § 130.001 shall be cited in court by the police officer and, upon conviction for violation of § 130.001, shall be fined in an amount of not less than $250 or more than $1,000.

   (C)   Failure to conform to § 130.007 shall result in the imposition of a $500 fine to the property owner upon whose property such a non-conforming cistern, well, septic tank or pit exists. In addition to such fine, the Board of Public Works and Safety, upon proper petition by its authorized officials, and after notice to the property owner and hearing before the Board, may order such corrective action be performed as is necessary to bring such a cistern, well, septic tank or pit into compliance with § 130.007. The cost incurred as a result of such action shall be assessed as a lien upon the property owner’s land within the city.

   (D)   The custodial parent or legal guardian of any child who commits a curfew ordinance violation, as defined in § 130.008, violates § 130.008 and shall be subject to the following fines:
      (1)   Twenty-five dollars for a first offense;
      (2)   One hundred dollars for a second offense within a one-year period; or
      (3)   Two hundred dollars for a third offense and every subsequent offense within a one-year period.

   (E)   (1)   Any person owning a motor vehicle with sound amplification devices which violate § 130.037 shall be in violation of this code as well as the operator of such devices.
      (2)   Any person found in violation of § 130.037(A) and (B) shall be fined $50.
      (3)   Each day that a violation occurs shall constitute a separate offense.
