(A) No person or corporation shall permit or cause any locomotive engine, car or train of cars, to pass along or on any unprotected grade level railroad crossing of any city street within the city at a greater rate of speed than 40 mph. For purposes of this section, an UNPROTECTED GRADE LEVEL RAILROAD CROSSING shall be one that crosses a city street at grade level which does not have an operating automatic train activated warning signal with crossgates or signalmen.
(B) It shall be the duty of any pedestrian or operator of any motor vehicle, bus, car, truck, bicycle or motor bike to stop prior to crossing a railroad, to look both ways and then proceed only with caution when the way is clear.
(C) It shall be unlawful for any unauthorized person to walk along any railroad right-of-way within the city unless permission is granted from the operating railroad.
(D) Each railroad that operates within the city shall permit the City Engineer or his or her designee to conduct periodic inspections of the railroad lines and crossings within the city to ensure that the lines meet federal and state safety standards. The duty is upon the railroad pursuant to I.C. 8-6 to maintain its railroad lines and crossings.
