(a) Council hereby finds and determines that it is conducive to the safety of motor vehicle operators and pedestrians to prohibit the ability of motor vehicles to turn right on a red signal and, therefore, right turn on red shall be prohibited at the following locations within the City:
(1) Southbound on Brush Road, a right turn on red onto Chardon Road shall be prohibited at all times.
(2) Westbound on Brushview Drive, a right turn on red onto Chardon Road shall be prohibited at all times.
(3) Southbound on Richmond Road at the intersection of Wilson Mills Road (Monticello Blvd.) between the hours of 7:00 a.m. to 9:00 a.m. and 5:00 p.m. to 7:00 p.m. a right turn on red shall be prohibited.
(4) Northbound and southbound on Richmond Road, a right turn on red onto Highland Road shall be prohibited between the hours of 7:00 a.m. to 9:00 a.m. and 2:00 p.m. to 4:00 p.m. on school days.
(5) Eastbound and westbound on Highland Road, a right turn on red onto Richmond Road shall be prohibited between the hours of 7:00 a.m. to 9:00 a.m. and 2:00 p.m. to 4:00 p.m. on school days.
(b) The Safety Director is hereby authorized and empowered to erect all necessary and proper signs to advise the users of motor vehicles of the prohibitions set forth in subsection (a) hereof.

(c) Except as otherwise provided in this subsection, whoever violates this section is guilty of a minor misdemeanor. If, within one year of the offense, the offender previously has been convicted of or pleaded guilty to one predicate motor vehicle or traffic offense, whoever violates this section is guilty of a misdemeanor of the fourth degree. If, within one year of the offense, the offender previously has been convicted of two or more predicate motor vehicle or traffic offenses, whoever violates this section is guilty of a misdemeanor of the third degree.
